Court order
The North IRL septic court order, and where it stands now
In 2025 a federal court in Bear Warriors United v. FDEP stopped new septic permits in Florida's North Indian River Lagoon area to protect manatees. On October 8, 2026 the 11th Circuit vacated that judgment and sent the case back to the district court, so the permit ban is no longer in force. State ENR rules still apply.

What the court did
In Bear Warriors United v. FDEP Secretary, U.S. District Court for the Middle District of Florida, case 6:22-cv-2048-CEM-LHP, the trial court found an Endangered Species Act violation tied to manatees and ordered FDEP to stop issuing new septic construction permits in the North Indian River Lagoon BMAP area. The order took effect on July 17, 2025. In June 2025 the 11th Circuit Court of Appeals declined, 2 to 1, to pause it while the state appealed. While it was in force, FDEP's February 2026 permitting table listed no new septic construction permits in the North IRL and ENR for repairs there on any size lot.
How we got here
Six dates, from the first ENR rule to the 2030 deadline
- HB 1379 takes effectNew septic systems on lots of one acre or less inside any basin management action plan area must be ENR systems.FDEP HB 1379 fact sheet
- New systems in the lagoon areaNo new septic where sewer is available. Where it is not, only ENR systems, on lots of any size.s. 373.469(3)(d)1., F.S.
- North IRL court orderA federal court orders FDEP to stop new septic construction permits in the North IRL; FDEP listed repairs there as needing ENR. The 11th Circuit set the order aside on October 8, 2026.Bear Warriors United v. FDEP; FDEP table, Feb 2026
- HB 1417 takes effectHomes on more than 10 acres are out. A repair application now brings a written notice about 2030.HB 1417 (2026), Ch. 2026-2
- Appeals court sets the ban asideThe 11th Circuit vacated the North IRL permit ban and sent the case back to the district court. Rules there are in flux; check with your county.Talk of Titusville, Oct 8, 2026; Law360
- The deadlineConnect to central sewer if it is available, or upgrade to an ENR system that removes at least 65% of nitrogen.s. 373.469(3)(d)2., F.S.
The October 2026 appeal ruling
Status checked November 1, 2026 against the 11th Circuit's opinion on GovInfo (No. 25-11612, issued October 8, 2026; news reports followed on October 9).
On October 8, 2026 the 11th Circuit vacated the trial court's judgment, which also voided the septic permit restriction, and sent the case back to the district court for further proceedings. Reports so far do not say what, if anything, the district court will order next, and we have not seen a new FDEP permitting table. So the court-ordered rules are set aside for now, but the case is not over and the rules could change again.
What applies today
These come from state law, not the court case, and apply across the whole program area, the North IRL included:
- New systems: since January 1, 2024, no new septic system where sewer is available, and only ENR systems (or others reaching at least 65% nitrogen reduction) where it is not, on any size lot (s. 373.469(3)(d)1., F.S.).
- Repairs: since July 1, 2026, when you apply to repair, modify or replace a septic system, the permit office must notify you of the 2030 requirement (HB 1417, 2026).
- The deadline: by July 1, 2030, homes on 10 acres or less with septic in the program area must connect to sewer if available or upgrade to ENR (s. 373.469(3)(d)2., F.S.).
Before you plan a repair in the North IRL, ask your county health department, which issues septic permits, what it requires for your permit today. If your system is failing, installing an ENR system now settles the 2030 question at the same time. Separately, a Brevard County ordinance of October 9, 2018 requires advanced treatment septic systems (65% or more nitrogen removal) on the barrier islands and Merritt Island and on the mainland within 197 feet of the lagoon and its open-water tributaries; ask the county health department how it applies to your permit. More on repairs before 2030.

Money for an upgrade
Brevard's Save Our Indian River Lagoon program pays $6,000 to $20,000 toward an ENR upgrade for approved applicants, and approval must come before the work starts. See the Brevard septic grant and every other program on the septic grants hub.

Questions people ask
Can I get a septic permit in Titusville, Mims or Port St. John now?
The federal order that stopped new septic permits in the North IRL was vacated on October 8, 2026, so it no longer blocks permits. State rules still apply: a new system must be ENR, and none is allowed where sewer is available. Ask the Florida Department of Health in Brevard County what your permit needs today.
Do I have to install ENR if my septic fails in North Brevard?
A new system, or a replacement the health department permits as a new system, must be ENR. An ordinary repair permit has no ENR requirement under state law now that the order is vacated, but the permit office must tell you about the 2030 rule, and a 2018 Brevard ordinance requires advanced (65% nitrogen) systems on Merritt Island, the barrier islands and within 197 feet of the lagoon.
Is the North IRL case over?
No. The 11th Circuit vacated the district court's judgment and sent the case back for further proceedings. The district court could rule again, so the rules in the North IRL could change. We check the case record and update this page when anything happens.
Did the court case change the July 1, 2030 deadline?
No. The 2030 deadline comes from state law, s. 373.469(3)(d)2., not from the court case, and it applies across the whole program area, the North IRL included.
