Merritt Island and the 2030 septic rule
Is Merritt Island inside Florida's Indian River Lagoon septic area? Yes. Essentially all of its roughly 7,200 septic parcels are inside, split between the Banana River and North IRL plan areas. By July 1, 2030 each must connect to county sewer where available or upgrade to ENR, and Brevard has required advanced systems here since 2018.

Is Merritt Island inside the area
Yes. Merritt Island is unincorporated Brevard County between the Indian River and the Banana River. Our count finds essentially all of about 7,200 septic parcels in ZIP codes 32952 and 32953 inside FDEP's program-area map. Central and south Merritt Island fall in the Banana River plan area; the north end is in the North Indian River Lagoon plan area.
How we counted (November 1, 2026): parcels the Florida Water Management Inventory (FLWMI, Florida Department of Health) marks as known, likely or somewhat likely septic, by physical-address ZIP code, counted only where the parcel touches FDEP's program-area map. Parcels, not homes, and ZIP codes do not match community lines exactly. See our data. Check your own address below; the result also shows which plan area you are in.

What the rule means here
Under Florida law, by July 1, 2030 homes on 10 acres or less with septic in the program area must connect to sewer if it is available, or upgrade to an enhanced nutrient reducing (ENR) system that removes at least 65% of nitrogen. The statute has no penalty clause. Since January 1, 2024 a new septic system in the area must be ENR, and no new septic is allowed where sewer is available.
Merritt Island had a local rule first. On October 9, 2018 Brevard County passed an ordinance requiring advanced treatment septic systems (65% or greater nitrogen removal) on the barrier islands, both the beaches and Merritt Island. Ask the Florida Department of Health in Brevard County what your permit requires before you plan any septic work.
Sewer or ENR: who to ask
The sewer projects on Merritt Island are Brevard County projects. Call Brevard County Utilities at (321) 633-2091 to ask whether sewer is available at your address. The county's Save Our Indian River Lagoon story map, tab 4, shows planned septic to sewer areas.
The county's status list (updated June 9, 2025):
| County zone | Status in June 2025 |
|---|---|
| Sykes Creek N, M and T | Under construction, about two years |
| Merritt C and Merritt F | Design complete, preparing for bidding |
| North Merritt E | Design, vacuum sewer |
| Merritt G | Design, vacuum and force main sewer |
| Sykes R | Design, vacuum sewer |
Design can take 12 to 36 months and construction 10 to 18 months, the county says. If no project reaches you, the 2030 path is an ENR system. See ENR vs sewer.
Projects and money
State lagoon grants to Brevard County for Merritt Island area sewer zones:
- Merritt Island Zone C $1,900,000, Zone F $2,000,000 and Zone G $10,327,172 (2023-24)
- Sykes Creek Zone T $6,000,000 (2023-24)
- North Merritt Island Zone E $9,288,516 and Sykes Creek Zone M $3,859,716 (2024-25)
These pay for pipe in the street, not your yard. For owners:
- Brevard sewer quick connect grant: $1,600 per pound of nitrogen prevented, up to $12,000 for a gravity connection and up to $24,000 where a pump or force main is needed. In the county utility area it can pay the connection fee directly. Plumbing under the foundation is not covered.
- Brevard septic upgrade grant: at least $6,000 and up to $20,000 per parcel for an ENR upgrade. WUSF described a Merritt Island parcel sending 27 pounds of nitrogen a year that qualified for the full $20,000; the neighbor at 3 pounds qualified for about $2,500 before the $6,000 minimum was set. Costs
WUSF reported the average Brevard ENR upgrade at more than $22,000 in late 2025, up from $18,000 in 2020, before any grant. A sewer connection depends on whether your street gets gravity, vacuum or force main sewer and how far the tank is from the line.

Does this apply to your home?
The free address check answers in about ten seconds: inside the program area or not, septic or sewer on record, lot size and, in Brevard, a grant estimate.
Repairs before 2030
If your system fails first, a repair is the natural moment to upgrade, and the permit office will remind you of the 2030 rule. Since July 1, 2026 the health department must tell owners about the rule on any repair, modification or replacement application. For the Banana River area FDEP's February 2026 table lists no ENR requirement for an ordinary repair. On the north end, the North IRL repair listing came from a federal court order that the 11th Circuit vacated on October 8, 2026 (details). The county's 2018 ordinance still applies on Merritt Island, so ask the Florida Department of Health in Brevard County what your permit requires. More in septic repair.

Questions people ask
Is all of Merritt Island in the 2030 septic area?
Yes. Our count finds essentially every one of about 7,200 septic parcels in ZIP codes 32952 and 32953 inside FDEP's program-area map. Central and south Merritt Island are in the Banana River plan area and the north end is in the North IRL plan area. Either way the July 1, 2030 deadline applies.
Does Merritt Island already require a special septic system?
Yes, under a county rule. On October 9, 2018 Brevard passed an ordinance requiring advanced treatment systems, with 65% or more nitrogen removal, on the barrier islands, Merritt Island included. Ask the Florida Department of Health in Brevard County what that means for your permit.
Is sewer coming to my Merritt Island street?
Maybe. Brevard has sewer zones in Merritt Island, North Merritt Island and Sykes Creek in construction, bidding or design. Check the county's Save Our Indian River Lagoon story map, tab 4, or call Brevard County Utilities at (321) 633-2091 to ask whether sewer is available or planned at your address.
How much grant money can a Merritt Island home get?
For an ENR upgrade, at least $6,000 and up to $20,000 per parcel, based on the nitrogen the county estimates your parcel sends to the lagoon. WUSF described a Merritt Island parcel that qualified for the full $20,000 while the parcel next door qualified for about $2,500 before the minimum. Get approved before work starts.
My system is old but working. Do I have to replace it now?
No state rule makes you replace a working system before July 1, 2030. If it fails first, a repair is the natural moment to upgrade, and the permit office will remind you of the 2030 rule. If sewer reaches your street sooner, the county can require a connection.
