Buying or selling a home with septic

Florida has no statewide rule that forces a septic upgrade when you sell a home near the Indian River Lagoon, but the 2030 requirement stays with the property, so buyers will price it in. Vero Beach is the exception: STEP sewer connection is required within one year of a sale. Check the address, the system type and sewer plans.

Is there a rule at sale? The Vero Beach exception

We have not found a statewide rule that requires a septic upgrade or inspection when a home sells in the program area. The 2030 rule applies to the property whoever owns it. One local rule does tie to sale: Vero Beach utility customers on septic must connect to the city's STEP sewer within one year of a sale or transfer, or by June 1, 2028, whichever comes first.

Six things to check

  1. Inside or outside the area. Run the address check. Outside means the 2030 rule does not apply.
  2. Septic or sewer. State records are a start; the seller's utility bill settles it.
  3. What system is there. Ask for the septic permit and any repair permits from the county health department, and the system's age.
  4. Is sewer coming. Ask the utility for any planned project, connection notice or assessment on the parcel. In Indian River County a notice starts a 365-day clock.
  5. Lot size. Homes on more than 10 acres are outside the 2030 rule since the 2026 amendment.
  6. Grant status. In Brevard, ask whether a SOIRL grant was approved or paid for the parcel; approval comes before work and may not carry over.

For sellers

An upgraded system or a finished sewer connection removes a cost the buyer would otherwise price in. If you are not upgrading, have the facts ready: plan area, system type, any notice, and a written quote, so the buyer is negotiating over a number and not a guess.

For buyers

Ask for a septic inspection and a written estimate for the 2030 fix before your inspection period ends. An old system is the biggest risk: if it fails, the repair is the natural time to pay for the 2030 upgrade. In the North IRL, permit rules for repairs could change again while a federal case continues. Where it stands.
